Can a CCTV directly overlook a neighbour

Hi, I'm new here.

Most people have nosy neighbours. I have a nutty neighbour!

Despite hostile representation I was recently granted planning permission to extend my house. Clearly it was not well received but now the neighbour has resorted to erecting a CCTV camera high on an external wall which may just include his shed roof but will survey my back garden where the proposed development will shortly commence. The fence is 6'6".

Is this legal? It does seem a gross invasion of privacy.

I think a cosy chat is probably out of the question so I could do with any available information on rights and quietest methods of dealing with such a case. I'm not keen to involve the police unless neccessary.

Having said all of this, I'm warming to the idea of CCTV (but on my property only)

Yes he is breaking the law! The police cant realy do a lot and its going to cause you trouble calling them with the neighbour! The council will be very intirested though, Its up to you what you decide but if it is blatently looking in your garden, Your neighbours are in breach of privacy laws!

Iain is spot on. You must in all cases try to avoid overlooking a neighbours property and are only okay to do so if the peripheral area is unavoidable. Even if it requires masking or shading your camera and even then it can't be used to spy on neighbours. Total privacy violation!

Again we think IStorm are right if a neighbour is clearly over looking your land with CCTV , it may be against the privacy laws, however we note you say they are unhappy with an extension you are about to build, we wonder as you do not say, is the extension going to effect their privacy? May be they are trying to demonstrate what it feels like to be over looked ? and from your comments above it seems to be working may be it would be best not to react, are you aware if the cameras are functional? ( not dummies ) are they hard wired or wireless, if wireless you may be able to check the view with your own 2.4Ghz scanner as most CCTV works on this band.

Agree with systems.support check first that camera (dummies or not), and no need to react so far.. as everybody has right to keep their own safety
