Default Neighbour with audio cctv

Please can anyone tell me the law on audio CCTV equipment on a residential property, My neighbour has placed a audio CCTV camera around 2 foot from my bedroom window albeit looking at her drive way, my question is can she legally do this as she will be able to hear conversations etc that go on at both sides of her property.

I have rang citizens advice, the police, the council and no one seems to able to tell me as they have never heard of a residential property having audio CCTV before, she has no signs up to inform that she is recording nor that they are audio, we have over heard her saying this whilst on her telephone and as we don't get on she made sure I heard every word, I have checked the cameras on the internet and they are defiantly have audio recording on them

Sorry to the say the only legislation that sounds like it might apply in this case is one of nuisance.

If you cannot resolve the issue talking to your neighbour the next step is to make a formal complaint to your council and consulate a solicitor

Unfortunatly there isnt a lot you can do about it, i would put in a formal complaint to the city council.

Can I make a suggestion ?

Have you spoken with the neighbour? I am surprised they have installed an audio cctv camera so far away from the subject they are trying to record, assuming the camera is mounted at first floor window height then you'd have to be shouting quite loud to record well. Especially if there is a bit of wind.

Go and speak to the people next door and tell them of your concerns. I am sure they don't want to upset you (they probably think they are doing you a favour by discouraging crime !).

Ask if you could have a look and a listen to see exactly what is being seen and recorded - have someone shout in your bedroom to see if it can be heard.

We always recommend speaking with next door neighbours prior to fitting cctv and inviting them round to see the results after fitting just to put their minds at ease.
